JUSTICE OF THE PEACE SERVICE AGREEMENT

Justice of the Peace Service Agreement (the “Agreement”) made and entered into as of _______________20___, by and between William P. Perkins, Justice of the Peace (the “JP”), and ________________ and ___________________ (the “Couple”). Whereas the Couple wishes to retain the services of the JP and the JP desires to be retained by the Couple pursuant to the terms hereinafter set forth.

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. Event Details

2. Services Provided

  • The JP agrees to provide the following services:

  • Consultation with the Couple to plan the ceremony flow, draft vows,

  • Ceremony segments and finalize the ceremony.

  • Attendance at the rehearsal, if such service is requested.

  • Arrival at the ceremony venue at least _________ minutes prior to the scheduled start time.

  • Officiating the civil marriage ceremony in New Hampshire on the date and time specified herein.

  • Proper execution of the marriage license immediately following the ceremony.

  • Filing the completed marriage license with the appropriate town or city clerk within the six days of the ceremony as required by law.

3. Fees and Payment Schedule

  • The total agreed-upon fee for services is $________.

  • Retainer/Deposit: A non-refundable retainer fee of $________ is due upon the signing of this Agreement to secure the date and time.

  • Balance Due: The remaining balance of $______ is due no later than five business days prior to the ceremony date.

  • Payments will be made by check or cash.

4. Marriage License Requirement

The Couple explicitly understands that it is their sole responsibility to obtain a valid marriage license from the appropriate town authorities prior to the ceremony and present it to the JP on the date of the ceremony along with proper identification.

Legal Notice: By law, the JP cannot perform a marriage ceremony without a valid marriage license in hand at the time of the ceremony. No refunds will be given if the ceremony cannot proceed on the ceremony date noted above due to a missing or invalid marriage license.

5. Lateness and Delays

The ceremony shall begin within sixty minutes of the scheduled start time. If the ceremony is delayed beyond this time due to circumstances within the Couple’s control, a late fee of $25 per half-hour may apply, subject to mitigating circumstances. If the delay exceeds two hours from the scheduled start time, the JP reserves the right to leave, and all fees paid and owed will be forfeited.

6. Cancellation and Refund Policy

  • Cancellation by the Couple: If the Couple cancels the event more than five business days before the ceremony date, any balance paid (minus the non-refundable retainer) will be refunded. Cancellations made after five business days before the wedding date forfeit all fees paid.

  • Cancellation due to the venue’s inability to host the ceremony through no fault of the couple will receive a full refund.

7. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the State of New Hampshire without regard to its conflicts of law provisions.
